The following Terms & Conditions apply to En Pointe Aerial Academy.
As a participant, you acknowledge that you have read and understood the following Terms and Conditions and agree to be bound by them. We may sometimes add, change or remove our Terms and Conditions. The most up to date Terms and Conditions will always apply, which you can find in studio and on our website.

By signing your terms and conditions and completing your enrolment forms, you agree to be bound by the terms and conditions. You must ensure that you are aware of and understand these terms and conditions.

Attending classes can involve risk of personal injury. While En Pointe take all reasonable care and steps in the conduct of its classes; it accepts no responsibility for injury or loss caused during the classes or whilst participants are at the studio. You are responsible for ensuring that you are physically and mentally fit for the class and during the class you must at all times, take care of your own personal property and safety.

COURSES
All apparatus based courses including but not limited to; pole dancing, aerial hoop, silks, aerial hammock courses, spin pole courses, 4 or 8 week mini courses, require a $50 deposit upon booking to secure your place.
All new students must pay, in full, their first (or only) course prior to the commencement of their first class.
All current students must pay in full, their first (or only) course before the conclusion of week 8 of the previous term.
All second course fees must be paid in full before the conclusion of week 1 of the new term.
All third course fees must be paid in full before the conclusion of week 3. (This includes casuals/mini courses as second or third fees)
Cancellation of a course within 7 days of the Term commencing will result in the $50 deposit being owed or not refunded.
Cancellation of a course once the Term has commenced will result in full course fees being owed in full, or no refund of fees being given.
Subject to approval of the Studio, you may transfer your course to another person for that same time/day class but all transfer and payment arrangements must be agreed between the transferring students and then approved by the Studio. You remain responsible for payment and the Studio is not liable to chase fees from the transferring student.

We do not refund or credit for absences. No refunds/credits are given for students missing classes due to vacation, holidays, days off, etc.

If you are unwell and unable to attend a class, the studio will use it’s discretion to offer a makeup class if a suitable class is available, this is dependent on class times, days, apparatus availability.
If you are unwell or injured but not contagious, you are recommended to attend class to observe and make notes so as not to fall behind upon returning to class physically.

If you are unable to continue classes for a predetermined amount of time due to injury or illness, upon receipt of a medical certificate, the studio will issue a credit to your account for remaining prepaid classes.

If you are unable to continue classes indefinitely due to injury or illness, upon receipt of a medical certificate, the studio will issue you a refund for remaining prepaid classes.

If there are any unforeseen circumstances that prevent you from continuing at En Pointe indefinitely, prepaid class payments may be transferred to another student at the studios discretion.

CANCELLATIONS BY THE STUDIO
We reserve the right in our sole and absolute discretion to cancel your course/class/workshop/etc if you do not comply with these Terms and Conditions, your enrollment forms, or our Policies. We may cancel your membership on any such terms as we deem appropriate in these circumstances and your signing of these terms and conditions acts as a complete waiver to the incurrence of any liability on our part.

CANCELLATION OF CLASSES
We reserve the right to change/cancel any class, workshop or private tuition with minimum 1 hours’ notice. This could be due to illness, not reaching minimum numbers required to run it, or another reason out of our control. We will of course endeavor to give you as much notice as possible where able to.
If we cancel a course/class/workshop/etc for reasons outside our control and are unable to offer a suitable alternative, a refund/credit for any remaining classes already paid for may be offered at the discretion of the studio.

LATE PAYMENTS
All overdue invoices will incur a late fee of 10% of the total purchase price, added the day after the invoice was due. EG. A $199 course class that is overdue will result in a $19.90 late fee being added, increasing the payable bill to $218.90

PRIVATE LESSONS
Private lessons are private sessions for 1-4 people with the instructor of their choice.
Bookings: are essential and can be made online at www.enpointeaerial.gettimely.com or by contacting the studio.
Payment: must be made in full in cash or EFT at the studio, or online with PayPal or by credit/debit card upon booking.
Cancellation policy: Cancellations within 24 hours of the lesson commencement will result in full payment being required or no refund given. Non-attendance will also result in full payment being required or no refund given. Cancellations prior to 24 hours of the lesson commencement will not require payment or will result in a refund being given or your account being credited.

CASUAL CLASSES
Casual classes are $15 drop in pay per class.
Some are open to non-students but some require previous experience, please check with the studio on a class by class basis.
Bookings: are essential and can be made online at www.enpointeaerial.gettimely.com or by contacting the studio.
Payment: must be made in cash or EFT at the studio prior to the commencement of the class.
Cancellation policy: Cancellations within 24 hours of the class commencement will result in full payment being required or no refund given. Non-attendance will also result in full payment being required or no refund given. Cancellations prior to 24 hours of the class commencement will not require payment or will result in a refund being given or your account being credited.

PRACTICE SESSIONS
Practice sessions are unsupervised training time within the En Pointe studios.
The fee is $5 for current En Pointe course students or $10 for non En Pointe course students.
Prior to commencing training, all participants must sign and adhere to the “Practice waiver”.
Bookings: are not a requirement but can be made online at www.enpointeaerial.gettimely.com or by contacting the studio.
Payment: must be made in cash or EFT at the studio prior to the commencement of the session. (Please note we have a $10 EFTPOS minimum)
Cancellation policy: Cancellations do not incur any cancellation fees.

PHOTOSHOOTS
Photoshoots are run by external contractors and can be done on site at the studios or on location. All photoshoots require a deposit to be paid at the time of booking to secure your spot.

Deposit: a 50% deposit is required at the time of booking.
Full payment: remaining balance is due 7 days prior to the date of the event.
Payment: both initial deposit and remaining balance must be made in cash or EFT at the studio or online via PayPal or credit/debit card.
Cancellation policy: Cancellations within 7 days of the photoshoot commencement will result in full payment being required or no refund given. Non-attendance will also result in full payment being required or no refund given. Cancellations prior to 7 days of the photoshoot commencement will be refunded or your account being credited.
Photoshoot fees are transferable to another student.

WORKSHOPS
Workshops are specialty classes run by internal or external instructors. All workshops require a deposit to be paid at the time of booking to secure your spot.

Deposit: a 50% deposit is required at the time of booking.
Full payment: remaining balance is due 7 days prior to the date of the event.
Payment: both initial deposit and remaining balance must be made in cash or EFT at the studio or online via PayPal or credit/debit card.
Cancellation policy: Cancellations within 7 days of the workshop commencement will result in full payment being required or no refund given. Non-attendance will also result in full payment being required or no refund given. Cancellations prior to 7 days of the workshop commencement will be refunded or your account being credited.
Workshops fees are transferable to another student.

FUNCTIONS
We cater for all kinds of parties and groups; corporate groups, team building, sports teams, hens parties, birthdays or any other occasion. We offer a range of parties and functions to suit your occasion. We can even tailor the event to suit your party/groups theme. We hold functions at our fully equipped studios or depending on your party, we can come to you.
Functions can be booked at the studio on any apparatus we offer, or any style we offer or a mix.

All functions/parties, require a deposit to be paid at the time of booking to secure your time/day/instructor.

Cancellations prior to 7 days of the function commencement will incur a $50 cancellation fee with the remaining balance paid being refunded or your account being credited.

STUDIO HIRE
All 3 rooms of En Pointe Aerial Academy are available for hire.
Studio hire is available for purposes including solo training, competition training, personal training, photography, space hire, etc. During studio hire the studio is unsupervised, with the exception of surveillance cameras, and En Pointe staff may not be present.
Studio hire is available for $15 per hour during opening hours. $30 per hour outside of opening hours.
Bookings: can only be made by contacting the studio.
Payment: must be made in cash or EFT at the studio prior to the commencement of the hire.
Cancellation policy: Cancellations within 24 hours of the hire time will result in full payment being required or no refund given. Non-attendance will also result in full payment being required or no refund given. Cancellations prior to 24 hours of the hire time will not require payment or will result in a refund being given or your account being credited.

SPECIAL ORDERS
The studio may offer special orders for physical stock including but not limited to; pleaser heels, grip aids or active wear. All special orders must pay 50% of the total price as a deposit.
Special orders may not be cancelled but may be transferred to another student.

GIFT VOUCHERS
Gift vouchers can be used for any part of the studio sales, including but not limited to; courses, classes, merchandise, studio hire.
Purchasing: gift vouchers can be purchased online from www.enpointeaerial.gettimely.com or at the studio reception.
Payment: must be made at the time of purchase in cash or EFT at the studio or via PayPal or credit card online.
Expiry: gift vouchers have a 3 years expiry from the date of purchase.

PHONE PAYMENTS
Invoices must be paid at the studio via cash or EFTPOS or over the phone by credit/debit card.
We will not store your card information.
To pay an invoice via phone payment, call the studio on 0403943447 during reception hours and have your card details ready.

ADVANCED PAYMENT PLANS
Advanced payment plans are available. These involve crediting your existing account to pay for future courses, classes, merchandise, etc
It is not a lock in contract but allows participants to credit their account in nominations they choose on days they choose to pay them.

PHOTOGRAPHY
You consent for security and or promotional purposes to images, video and/or audio being taken of yourself, your children or of children for whom you are responsible for. Visitors and photography are prohibited in class to ensure the privacy and comfort of all students unless otherwise allowed by the instructor. The studios are equipped with security surveillance for safety and will only be accessed in case of an incident. We will reconfirm your consent to use any photography, video or audio for promotional purposes upon taking the photo or footage.

PROPERTY
You are responsible for and cannot hold us liable for any damage, loss or theft of any personal property that you may incur while on the premises of our studios.

POLICIES
You acknowledge that you have read and agree to our Policies including our Privacy Policy. It is your responsibility to inform yourself of these Policies. Our Policies can be found on our website.

YOUR INFORMATION
It is your responsibility to inform us immediately if your contact, emergency contact or banking details change. We will send all correspondence and notices to the last address you have provided us.

YOUR HEALTH AND SAFETY
It is your responsibility to notify us in the event of any injury or medical condition prior to class whether you feel that it is relevant to your performance in class or not. If we are of the view that you are not fit to participate in a class, we have the right to refuse your participation and our decision is final. To continue attending classes, we reserve the right to ask you to provide medical clearance certificate signed by your doctor. You must not attend the studio if you have a contagious illness or physical ailment such as open cut or sore, or where there is any other risk to other students, instructors, guests or yourself. You agree to pay the cost of and authorise us to take all steps we consider reasonably necessary to protect your welfare in the event of personal injury, including the administration of any emergency medical treatment and ambulance transportation.

OUR RIGHTS
If we do not enforce our terms and conditions under any agreement with you at any time, we have not waived those rights.

ENTIRE CONTRACT
These Terms and Conditions, our Policies and your enrolment forms including waiver and release forms, practice waiver or studio hire agreement, as updated and amended by us from time to time, forms the entire contract you have with us.
